Phase 2 co-design finishes for ACH 2021

Phase 2 of the co-design process for the development of the supporting regulations and guidance which will underpin the Aboriginal Cultural Heritage Act 2021 has concluded. The Department of Planning, Lands and Heritage (DPLH) released a suite documents informed by the Phase 1 co-design process, and continues to seek stakeholder input to the process through a series of public co-design workshops across the State.  

 CME continues to actively participate in this process, and has provided a written submission to Phase 2 which will be available on the DPLH website shortly

CME will continue to engage with DPLH as Phase 3 approaches, with the expectation that Phase 3 is to include draft Regulations and finalised guidance documentation for review. We also expect the announcement of the Aboriginal Cultural Heritage Council (ACHC) inaugural members will occur in late September, prior to the commencement of Phase 3. 

The development of the supporting documents, regulations and appointment of the ACHC is critical to the success of the regime, and CME will continue to input into the process of co-design to achieve a practical, workable regulatory framework which functions for all stakeholders.    

  Consultation continues on Policy Framework for Diversification Leases   

The DPLH continues to progress drafting of amendments to the Land Administration Act 1997 (LAA). These amendments will enable a new form of non-exclusive leasehold tenure, which will be known as a diversification lease. The lease is intended to facilitate a more flexible leasehold tenure, including providing for multiple concurrent land uses. Of particular interest to the resources sector is the potential to use diversification leases to facilitate large-scale renewable energy projects. 

 DPLH released an Exposure Draft Policy Framework document, seeking stakeholder feedback on the use of diversification leases. This Policy Framework is intended to guide the implementation by the Department of the Act amendments pending successful passage. A detailed summary of the proposed amendments to the LAA are available on the DPLH website, with a draft Bill expected later this year. 

CME made a submission to this process and will continue to engage with DPLH to discuss areas of concern in the lead-up to the release of the draft amendments for consultation.
